Fence building - rules you need to know
Fence building is an important part of property, which influence not only on area appearance, but also on our privacy, safety and comfort. Altough before buying a fence it is worth to know, what are the regulations and laws around building fences. In this article we will tell you about, when building a fence requires permission, where to declare it and many more.
When fence building requires permission?
On a daily basis, building a fence do not require any permissions and other papers. Situation changes, when fence distinguish two areas with big height difference and it is required to make a resisting wall. In that case, fence building need to comply with all necessary safety rules, what comes with permissions and controls.
Moreover, permission like that we will also need, when a fence will be situated near the antique building. All buildings in this type of area need to have permission.
It is worth to quote something that may interest you: „Permissions for construction is not required by fence "building", but due to art. 3 point 6 of Building law "a building" is a making of "building object" in certain place and also rebuilding and overbuilding. Therefore, fence is a building object."

When we want to build a fence which will provide us with privacy and will seperate us from our neighbour such as shutter fence VERO in non-transparent version, it needs to be fully in our part of area. Even the smallest break of a border can cause our neighbour to make us some problems. Due to it, we recommend building fences with some distance from the border.
In what conditions we will build a fence without permission?
In 2015 Building law was highly simplified in case of situating small building objects, for which we include fences. Without formalities we can build a fence high up to 2,2 meters. Same situation apply to situating and renovating fences between building properties, which adjoins with each other or when build at the side of a road and other public facilities. It is huge change, because until now there was permission needed.
When a fence is a building object?
Fence is a building object, when its construction is included in a permission of, for example, family house. It depends on the condition of a fence if it will be a building tool or it will be treated like building object.
When a fence is a resisting wall?
Resisting wall duty is to protect certain area from collapsing ground in a moment, when fences seperate two areas from themselves. If we will decide, that crucial ability of a certain contruction is protecting from those situations, we need to say its resisting wall. It is worth mentioning, that a wall which is a resisting one and pretect from ground collapsing, is not a fence.
Where we need to notify fence building?
If there will be a necessity to notify fence builiding, we should give required document to City Hall. While we fill the notification, it is required to give a type of a fence, a way in which the works will be done and dates. Notification should be given to City Hall 21 days before works begin.
How long should be a distance between a fence and a border of a property area?
A main rule is, that none part of a fence cannot hang out from property. A fence cannot break a border of a road. While planning a fence it is worth checking, if there are no plans for rebuilding a road in following years.
Wickets and gates - what are the measurements required?
To allow entering property area, there should be wicket and gate installed. Only regulations which specify issue of wickets and gates are: - minimal width of a gate – 2,4m. - minimal width of a wicket – 0,9m. Worth mentioning, that gates and wickets cannot open to outside of a property and its parts can't be dangerous to people.
